Terms of Service

These Terms of Service govern your access to and use of Diffui. By accessing or using Diffui, you agree to these Terms. If you do not agree, do not use the service.

Use of the service

Diffui is a software service for generating and managing interface-related creative outputs and related project content. The service may be invite-only, experimental, or in beta, and features may change at any time without notice.

Eligibility and account access

You must be legally capable of entering into a binding agreement to use the service. You are responsible for maintaining the security of your account, credentials, and any API keys issued to you, and for activity that occurs under your account.

You retain whatever rights you have in content you submit to Diffui, subject to any rights needed for the service to operate. You grant Diffui a limited, non-exclusive license to host, store, reproduce, process, and transmit your content solely as necessary to operate, secure, improve, and provide the service to you.

You represent that you have the rights needed to submit your content and that your content and use of the service do not violate these Terms or applicable law.

Service output

Generated outputs may be produced by automated systems and may be inaccurate, incomplete, unavailable, or similar to content generated for other users. You are responsible for reviewing outputs before using, publishing, distributing, or relying on them.

Intellectual property

Diffui and its software, interface, branding, and related materials are owned by the service operator or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the service under these Terms, no rights are granted to you.

Feedback

If you provide suggestions, ideas, or feedback about Diffui, the service operator may use them without restriction or obligation to you.

Paid features

If paid features, credits, or billing are offered, you agree to pay applicable charges and authorize payment processing as described at the time of purchase. Unless required by law, fees are non-refundable once the purchased service, credits, or usage has been provided.

Suspension and termination

Access may be suspended or terminated at any time, with or without notice, if reasonably necessary to protect the service, comply with law, address abuse, or enforce these Terms. You may stop using the service at any time.

Disclaimers

To the fullest extent permitted by law, Diffui is provided on an "as is" and "as available" basis. The service operator disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and any warranty arising out of course of dealing or usage of trade. The service operator does not warrant that the service will be uninterrupted, secure, error-free, or that content or outputs will be accurate or reliable.

Limitation of liability

To the fullest extent permitted by law, the service operator and its affiliates, licensors, service providers, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or use, arising out of or related to the service or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the aggregate liability of the service operator for all claims arising out of or relating to the service or these Terms will not exceed the greater of one hundred U.S. dollars (USD $100) or the amount you paid to Diffui for the service during the twelve months before the event giving rise to the claim.

Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the service operator and its affiliates, licensors, service providers, and personnel from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your use of the service, or your violation of these Terms or applicable law.

United States law and export compliance

The service is operated from the United States. You may not use the service if you are prohibited from doing so under applicable U.S. laws, trade restrictions, or sanctions. You agree to comply with all applicable export control and sanctions laws.

Governing law and venue

To the fullest extent permitted by law, these Terms are governed by the laws of the United States and, where applicable, the laws of the state in which the service operator principally operates the service, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in that state, and you consent to that jurisdiction and venue.

Changes to these Terms

These Terms may be updated from time to time. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms.
